ATA Carnet is a universally accepted customs document issued in 78 countries including India, aims at facilitating temporary admission of goods into a member country without payment of normally applicable duties and taxes, including value-added taxes. Its operation is administered by World ATA Carnet Council (WATAC), ICC, Paris which governs the operation of the ATA Carnets in all participating 78 countries. It eliminates the need to purchase temporary import bonds. So long as the goods are re-exported within the allotted time frame, no duties or taxes are due. The acronym ATA is a combination of French and English phrases "Admission Temporaire/Temporary Admission."

The ATA Convention is signed by 78 countries around the world, the system is a perfect illustration of how close cooperation between business and customs can facilitate and stimulate international trade. Each country in the system has a single guaranteeing body approved by the national customs authorities and the ICC World Chambers Federation. The National Guaranteeing Association is entitled to issue Carnets and to authorize local chambers on the national territory to deliver them on its behalf. In India, as the apex chamber, FICCI is functioning as Sole National Issuing and Guaranteeing Association (NIGA) for ATA Carnets and is responsible for issuing, discharging and promoting the system in the country.

ATA Carnets apply to three broad categories of merchandise: commercial samples, professional equipment and goods for use at exhibitions and fairs. With the exception of perishable or consumable items, the product range is nearly limitless. Carnets are regularly used to facilitate movement of almost all type of goods.

TIR Carnet

TIR Carnet is an international transport document that allows transport of goods from the customs office of departure to the customs office of destination under the TIR procedure, defined by the TIR Convention. India has acceded to the convention on June 15, 2017, and today, it has 71 contracting parties and 59 operational countries, including India. It covers the whole of Europe and reaches out to North Africa and the Middle East. More than 35,000 operators are authorized to use the TIR system and in 2016 around 1.5 million TIR Carnets were issued. Ultimately, the system facilitates and encourages international trade, and thereby creates benefits for individuals and nations.

TIR will be a boon to India's trade and aims to integrate the economy with global and regional production networks through better connectivity. It can be an instrument for movement of goods along the International "North-South" Transport (INSTC) Corridor and would be helpful in boosting trade with the Central Asian Republics and other Commonwealth of Independent States (CIS), particularly using ports in Iran like the Chabahar port.

TIR Carnet

FICCI has been appointed by the Central Board of Excise and Customs (CBEC) as National Guaranteeing Association under the Customs Convention on the International Transport of Goods under the Cover of TIR Carnets or the operation of TIR system in India.

FICCI, in its capacity as an apex organisation is already recognised as National Guaranteeing Association of India under the ATA Carnet system since 1989. ATA Carnet covers several areas for use including trade fairs, shows, exhibitions, meetings etc. for temporary export / import into a country, which is a signatory to the conventions governing ATA Carnets. It is administered worldwide by the World ATA Carnet Council (WATAC), Paris in association with the World Customs Organization (WCO).

At present 78 countries recognise ATA Carnet including India. A large number of Indian exporters are benefited and a number of Carnets were issued by FICCI contributing to the growth of exports from India.

WATAC under WCO is working towards digitization of carnet system: ATA Carnet Manager, WATAC

Ms Chai Yuan, ATA Carnet Manager, World ATA Carnet Council (WATAC) International Secretariat, Paris yesterday said that often called the ‘passport for goods’, the ATA-Carnet is an international customs document permitting duty-free & tax-free temporary export for goods up to one year.

Addressing the webinar on ATA Carnet organized by FICCI, jointly with the Film & Television Producers Guild of India, highlighting the importance of ATA Carnet instrument for the Media & Entertainment sector, Ms Yuan said, WATAC under the aegis of the World Customs Organization (WCO) is working towards digitization of the carnet system and currently six countries, i.e., UK, Russia, Switzerland, USA, Belgium and China are undertaking an e-carnet pilot project and on success, it will be implemented in other member countries of the ATA chain.

Ms Yuan further stated, “ATA Carnet facilitates duty-free and tax-free temporary export/ import of goods into foreign countries. It eliminates posting financial guarantee and no additional registration in the country of departure is required.” She further explained that the ATA Carnet reduces the risk associated with carrying large sums of foreign currencies and eliminates the need for a temporary importation bond and a cash deposit of duties & taxes.

“We have established a 5-layer risk management control scheme in order to make sure that duties and taxes are safe and secured and the risks are under control,” added Ms Yuan.

Mr PS Pruthi, Senior Consultant, FICCI & Former Member, Customs Excise & Service Tax Appellate Tribunal (CESTAT), said, “ATA-Carnet is also called the highway to easy import for its ease of process. The whole basis of the ATA is a single document that can be used for temporary import and export of goods.”

He also mentioned that in the past few years there have been various initiatives by FICCI such as the adoption of Carnet for various sectors such as press, TV & media, sporting events, film shootings as well as professional equipment. Mr Pruthi also touched on the expansion of customs ports authorized for ATA Carnet transactions and India-Taiwan Carnet protocol for free movement of exhibition goods between both countries. “India was not a very temporary- import friendly country but FICCI’s initiatives on Carnet have been successful in transforming the country into one,” he added.

Mr Ashok Kaul, Former CEO, RK Studio said, “If difficulties of temporary import are eased by ATA-Carnet, it will help filmmakers to go all over the world and shoot, and it will only add to uniting the world creativity.”

ATA Carnet is the simplest method of exporting goods on a temporary basis. Carnets are replacing normal Customs documentation enabling fast trouble-free importation into member countries without having to pay duty/ tax. The system gives several advantages to businessmen seeking new opportunities on foreign markets. It can benefit Business travelers/sales executives, Fair Exhibitors, Film and TV crews, Artists, Engineers, Educationalists, Entertainers, Sports teams and many more during their overseas trips. The key benefit is that it can be used for multiple trips throughout the period of its one-year validity. ATA Carnet is a temporary admission document, which simplifies the customs procedures and clearances in a foreign country, without paying duty or a bank guarantee for temporary import into that country. Like a passport for goods, ATA Carnet allows for the goods for which it was issued to enter any of the participating countries for up to one year. An ATA Carnet holder can avoid customs declaration and can do away with security deposit or guarantee in the country of temporary importation.

TIR aims to facilitate the international transport of goods under customs seal with a maximum coverage. The system provides a guarantee covering the customs taxes and duties at risk which is required to pass transit countries and provides a balance between the responsibilities of the customs authorities and the international business community. It prevents delays in border crossing operations- by minimizing the formalities decreases the transportation costs, as a result, encourages the development of international trade.

FICCI is the sole National Issuing & Guaranteeing Association (NIGA) for the operation of ATA & UN TIR Carnet system in India and has been closely working with the Central Board of Indirect Taxes & Customs (CBIC) for the smooth operation of system in the country.

Trade and Industry should take advantage of ATA Carnet: FICCI Workshop

Business community should come forward to utilise the vast possibilities of ATA carnet, according to an awarness workshop organised by Federation of Indian Chambers of commerce(FICCI) in co-operation with Ministry of Commerce, Government of India with the support of affiliated Chambers of Commerce and Industry and Associations.

Commissioner of Customs (Preventive) Sumit Kumar, who inaugurated the workshop, said ATA Cornett has been instrumental in greatly simplifying customs procedures related to temporary imports and exports.

"If you have an ATA Carnet Certificate, you can import and export vehicles, equipment and exhibition materials to any countries for a fixed period of time without any custom duty."

"The biggest port in India is opening up a huge development opportunity in Thiruvananthapuram and the Customs Department is always ready to do whatever it takes," he added.

The first shipment under the United Nations ‘Transports Internationaux Routiers’ (TIR) convention arrived in India from Afghanistan through Iran’s Chabahar Port.

The consignments arrived at port of Nhava Sheva, Mumbai and Mundra on Wednesday, officials said.

Welcoming the arrival of the maiden shipment, Pranab Kumar Das, Chairman, Central Board of Indirect Taxes & Customs (CBIC), Department of Revenue, Ministry of Finance, said the TIR convention will help in fast and easy movement of goods across multiple countries under a common customs document and guarantee.

India had joined the TIR Convention (the United Nations Customs Convention on International Transport of Goods under cover of TIR Carnets) on June 15, 2017.

The convention allows goods to be outlined in a TIR carnet and sealed in load compartments.

Customs officials verify the carnet and check the seals, with no need for physical checking of the contents, enabling shipments to pass through countries without being opened at borders.

“Reciprocal recognition of customs controls is at the heart of the Convention. This enables a facilitative and non-intrusive environment for multi-modal transport of goods through several countries,” Mr. Das said.

He said the convention will help boost India’s exports and enable greater participation in the global value chains.

Dilip Chenoy, Secretary General, FICCI, said, “TIR will play a pivotal role in improving ease of doing business and pave the way for smoother and safer transport of goods across international borders and will help boost trade between India, Central Asia, Europe and Russia.”

“It will act as a strong catalyst for moving goods using the multi-modal transportation route like Chabahar and International North-South Transport (INSTC) Corridor. The system is a win-win-win model for Customs, FICCI and the business community,” he added.

“The opening of Chabahar Port for TIR is hugely significant — offering connectivity for landlocked countries, seamless border crossing facilitation and intermodal capabilities,” said Umberto Pretto, IRU Secretary General.

“It also highlights how TIR has been chosen by these three countries as a key tool to help activate the Chabahar transport agreement. The operation will definitely open the door for activation of other intermodal corridors such as International North South Transport Corridor — connecting India to Central Asia, Russia and eventually Europe,” Mr. Pretto said.

India receives first shipment from Afghanistan via Iran's Chabahar Port

The first shipment from landlocked Afghanistan through the Iranian Chabahar port has arrived in India, marking a new beginning of trade ties between the two countries, bypassing Pakistan. The cargo arrived at the Mumbai and Mundra port Wednesday morning under the TIR ("Transports Internationaux Routiers") Convention that enables shipments to pass through countries without being opened at borders.

In May 2016, India, Iran, and Afghanistan signed an agreement on the establishment of a Transit and Transport Corridor among the three countries using Chabahar port as the regional hub for sea transportation. The agreement aimed at developing the southern Iranian port into a regional trade hub.

Chabahar port, inaugurated in 2017, has been built largely by India and provides a key supply route for Afghanistan while allowing India to bypass rival Pakistan to trade with Central Asia. Most of Afghanistan's imports and exports currently go through Pakistan, which Kabul accuses of harbouring the Afghan Taliban. The US State Department in November 2018 exempted the Chabahar port project from its sanctions on Iran in recognition of its importance to war-torn Afghanistan.

Afghanistan's exports to India reported an increase of 40 percent after the launch of an air corridor between Kabul and New Delhi in 2017. On 11 March 2019, India and Afghanistan operationalised another air corridor between Herat and New Delhi that is expected to further boost the bilateral trade.

World ATA Carnet Council meet in Jaipur

The World ATA Carnet Council (WATAC) meeting and workshop will be held in Jaipur on 15 and 16 November at Hotel Jai Mahal Palace and SMS Convention Centre respectively. The events aim to discuss and review various aspects pertaining to operation and administration of ATA Carnet System in member countries and to spread more awareness about ATA Carnet among Indian exporting fraternity & Indian customs.

First consignment from India to Russia under TIR in January

While India joined the United Nation’s Transport Internationaux Routiers (TIR) convention in March earlier this year, it will see the first consignment of goods dispatched to Russia from Mumbai port on January 16 under the convention. The TIR convention is an international transit system meant to facilitate seamless movement of goods within and among the parties to the convention. Currently, there are 71 parties to the convention, including the European Union. “The exports will have goods going via Iran to countries like Russia and Turkey,” said Sandeep Kumar, commissioner (customs & EP), CBEC. He added that the consignment would reach its destination in half the time under TIR route compared to old routes.

The TIR routes used for exports would do away with the the need for inspection of goods at intermediate borders as well as physical escorts. Further, customs clearance can take place at internal customs locations thereby avoiding clearances at border crossing points and ports that may often be congested. “Earlier exports would go through three to four international borders but this route via Iran seems less time consuming. Our focus is to transport goods exempting them from any duty or tax,” Kumar added. A dry run conducted by a freight association found that TIR routes led to halving of time and cost of such transport. The Federation of Indian Chambers of Commerce and Industry (FICCI) was appointed by CBEC as national guaranteeing association for the operation of TIR system in India. Movement under the TIR can be allowed by checking only the seals and the external conditions of the load compartment or the container thereby reducing border delays, transport and transaction costs.

Making his welcome address, Dr Sanjaya Baru talked about the benefits of TIR system and said, "TIR plays an important role in trade facilitation and has been a successful model for reducing trade transaction costs and facilitating higher growth of intra-regional and inter-regional trade."

He further stated that based on FICCI's vast experience on ATA Carnet management, CBEC has chosen FICCI as the National Guaranteeing Association for the operation of TIR System in India. It's a proud moment for FICCI and will be committed to work towards smooth and successful implementation of the system in India.

He also mentioned that given the significance of TIR in boosting regional connectivity, and India's accession to the convention, it is recommended for other BBIN countries to opt for TIR to improve the effective transit procedures among the four countries and by connecting the BBIN (Bangladesh, Bhutan, India and Nepal) region to other world markets. FICCI will extend its maximum support to CBEC to help other BBIN countries to accede to the convention and reap the benefits.

In his special address, Sandeep Kumar said that "The Government is looking at very active participation by the business sector to be able to use this particular convention that India has acceded to. Further he stated that the accession process will be completed on 16th December 2017 and planning to ship out first containers from Nhava Sheva to Russia via Iran under TIR by early January 2018"

India will start exporting container cargo to Russia via Iran and Azerbaijan from next month as it moves forward to operationalise international corridor INSTC, CBEC (Customs) Commissioner S Kumar said on Tuesday.

The move, he said, would cut down cargo transport time by half to nearly 17 days, from the earlier 35 days, using just the sea route.

"India will shift its first export consignment via Bandar Abbas to Russia from mid-January. It will probably transit Iran, Azerbaijan and then reach Russia," Kumar told reporters on the sidelines of a FICCI event here.

The Customs department has been receiving a lot of enquiries from garments and pharma sectors for using this route, he said, adding that the route would help in saving money as well as time.

"This initiative will operationalise the INSTC," Kumar said.

Currently, one has to either use Rotterdam port or land route via China to reach Russia and Central Asia. These are long, expensive and time-consuming.

International North-South Transport Corridor (INSTC) is a multi-mode network of sea, rail, and road route for moving freight among India, Russia, Iran, Europe and Central Asia.

The proposed 7,200-km long corridor is expected to increase trade connectivity among major cities of Mumbai, Moscow, Tehran, Baku, Bandar Abbas, Astrakhan and Bandar Anzali.

Kumar said India has become the 71st country to ratify the United Nations TIR Convention with an aim to boost trade and regional integration across South Asia and beyond, fast- tracking the region's potential to become a strategic trade hub.

TIR -- International Road Transport -- is the global standard for goods Customs transit managed and developed by IRU (International Road Transport Union).

FICCI has been appointed by the CBEC as the National Guaranteeing Association for the operation of the TIR system in India.

About functioning of the association, Kumar said the exporter fills in a document in the country where the export starts and the body guarantees making good the duty for these goods in case these do not reach the destination safely.

CBEC appoints FICCI as National Guaranteeing Association for operation of TIR system in India

FICCI has been appointed by the Central Board of Excise and Customs (CBEC) as National Guaranteeing Association under the Customs Convention on the International Transport of Goods under the Cover of TIR Carnets or the operation of TIR System in India.

TIR is an internationally successful customs transit system that enables movement of goods between countries affiliated to the TIR Convention, a 1975 UN-ratified agreement allowing for duty-free movement of freight across nations. It is overseen by the United Nations Economic Commission for Europe (UNECE), and managed by IRU, Geneva. TIR stands for "Transports Internationaux Routiers."

India ratified the convention on June 15, 2017, and today, it has 71 contracting parties and 58 operational countries, including India. It covers the whole of Europe and reaches out to North Africa and the Middle East. More than 35,000 operators are authorized to use the TIR system and in 2016 around 1.5 million TIR Carnets were issued. Ultimately, the system facilitates and encourages international trade, and thereby creates benefits for individuals and nations.

TIR will be a boon to India's trade and aims to integrate the economy with global and regional production networks through better connectivity. It can be an instrument for movement of goods along the International "North-South" Transport (INSTC) Corridor and would be helpful in boosting trade with the Central Asian Republics and other Commonwealth of Independent States (CIS), particularly using ports in Iran like the Chabahar port.

Introduce ATA Carnet: FBCCI

The government should introduce the ATA Carnet system in Bangladesh as soon as possible, the country’s apex trade body says.

Moreover, the Federation of Bangladesh Chambers of Commerce and Industry (FBCCI) should be appointed as the National Guaranteeing Association (NGA) for ATA Carnet, it adds in its formal proposal for the national budget for the next fiscal year (FY18).

ATA Carnet is an international uniform customs document that permits duty-free temporary entry of goods into a member country without the need to raise customs bond, payment of duty and fulfilment of other customs formalities in one or a number of foreign countries.

The countries that sign and ratify the Customs Convention on ATA Carnet are considered as members of the system.

According to the FBCCI: “ATA Carnet will prompt our export interests as well as facilitating monitoring temporary imports which, take place in the business process including trade in transit.”

The FBCCI stressed on ratification of World Customs Union (WCO) ATA Carnet convention as well as Istanbul convention 1990.

The apex trade also urged the government to appoint itself as the NGA, which has to be approved by the National Revenue Board (NBR).

The FBCCI is the only licensed organisation with its 357 affiliated associations and 74 chambers representing the entire Bangladesh business system.

Moreover, being a founder member of the International Chamber of Commerce Bangladesh (ICCB), it is the only legal trade body to be appointed as ATA Carnet NGA.

In India, the Federation of Indian Chamber of Commerce and Industry (FICCI) is the sole national issuing and guaranteeing association for ATA Carnet.

The system is jointly administered by the WCO and ICC globally.

FICCI Organised Workshop on ATA Carnet

Mr. Pranab Kumar Das, Chief Commissioner of Customs, Chennai Zone and Mr. P.S. Pruthi, Former Member, Customs Excise & Service Tax Appellate Tribunal (CESTAT) interacted with the participants of the Workshop on ATA Carnet and responded to several queries while clarifying doubts on the operational aspects of ATA Carnet.

The workshop was organized by FICCI jointly with the Federation of Indian Export Organisations (FIEO), Chennai highlighted the importance of the ATA Carnet instrument for the business community.

The workshop drew participation from industry experts, extensive representation from export promotion councils, film associations, freight forwarding companies, customs house agents, fair and exhibition organizers. This event provided exporters and business experts with a unique opportunity to share their mutually beneficial knowledge and experiences. The industry discussed issues involved with respect to temporary imports of goods and drew benefit from the deliberations of the sessions.

Vijayalakshmi told The Hindu . She said as it was restricted to only metros. They decided to create awareness through Vizagapatam Chamber of Commerce and Industry in Visakhapatnam and chambers in Vijayawada, Tirupati and other tier-2 and 3 cities.

She said they were registering an increase in use of ATA Carnet by 10% over past few years. The present value of transaction is put at $25 million. India and 75 countries are signatories to the conventions governing ATA Carnets. FICCI is the designated agency to facilitate it. It was introduced in 1963 and in India through FICCI in 1990.

She said ATA Carnet was a joint initiative of the World Customs Organisation (WCO) and World Chambers Federation (WCF), which initiated the system. Ms. Vijayalakshmi said it entailed less administrative work and increased customs safety since the payment of import duties and taxes were guaranteed by the guaranteeing association affiliated to the ATA guarantee chain in the territory of temporary admission.

Ease of Doing Business - Expansion of Scope of ATA Carnet System in India

The Central Board of Excise & Customs (CBEC), Department of Revenue, Ministry of Finance, Government of India announces the Expansion of Scope of ATA Carnet System in India vide its Notification No.58/2016-Customs dated 5th October 2016 by amending the earlier Notification No. 157/90-Customs dated 28th March 1990 extending the scope to cover private exhibitions, fairs, meetings, demonstrations, similar show or display. Presently, the ATA Carnet facility is restricted to only goods meant for government approved exhibitions, fairs, meetings or similar events. This was one of the major hurdles faced by the foreign businessmen who wish to do business in India.
Welcoming the government’s announcement, Dr. A. 'Temporary passports' for goods on the rise

Why does an art dealer needs to obtain a “passport” for a collection to exhibit in a US gallery for three days or how can a leather bag manufacturer ensure physical presence of sample of his products at a fair in Japan for a week?

These Indians need to get a ‘temporary’ customs papers — ATA Carnet — for the gadget or wares. “It’s like passport for goods,” said S Vijayalakshmi, Deputy Director at FICCI’s ATA Carnet wing, told Business Line. FICCI is the sole national issuer and guarantor for ATA Carnets in the country.

As many as 74 countries, which are also prominent trading partners of the country, now recognise and accept India-issued ATA Carnets.

ATA Carnet is an internationally accepted customs document used by exporters, manufactures, professionals from India, to travel abroad with commercial samples for participating in exhibitions, trade fairs or business and promotional tours.

This admission document simplifies the customs procedures and clearances in a foreign country, without paying duty or a bank guarantee for “temporary import” — up to one year — into that country.

“Usage of ATA Carnet has been growing in India. From just six issuances in 2003, the figure have grown to over 500 in 2015-16,” said Vijayalakshmi. The documents let short period of entry in a foreign country for goods worth $28 million. The permits sought last year was primarily for jewellery, automotive parts, leather goods and film equipment. Similarly, India accepted about 2000 ATA Carnets from overseas in the previous fiscal.

The FICCI official said the Centre is considering to expand the scope of ATA Carnet convention. “This would allow foreign professional equipment, commercial samples and private exhibition temporary entry into the country”, she explained. At present, India is a signatory to convention on exhibitors and fairs only. The proposed expansion would help overseas business community, professionals, film shootings units, musical troupes, sports people and media to carry their wares to India.

PS Pruthi, former Member (Tribunal) of the Union Ministry of Commerce said that FICCI was pursuing the subject with the Finance Ministry. The Centre needs to amend the relevant customs notification (157/90) through Parliamentary approval for accommodating new areas under ATA Carnet system.

The exim community and traders in Kerala should use the ATA Carnet facility promoted by FICCI, K.N. Raghavan, Commissioner of Customs, Kochi, has said.

An ATA Carnet holder can avoid customs declaration and do away with security deposit or guarantees. In India, FICCI is the sole national guarantor for ATA Carnets.

The Customs Commissioner also called for concerted efforts from stakeholders to attract more cargo through ICTT Vallarpadam.

Satish Kumar Reddy, Director (ICD), CBEC, Ministry of Finance, touched upon the importance aspects of ATA Carnet, its benefits and legal aspects.

Jagdish Singh, Commissioner of Central Excise and Service Tax also urged the trading community to utilise the ATA Carnet facility for their international business transactions whenever required.

FICCI inks deal with Taiwan's trade body

In a bid to facilitate duty free temporary admission of goods and exhibits between India and Taiwan, the Federation of Indian Chambers of Commerce and Industry (FICCI) and the Taiwan External Trade Development Council (TAITRA) on Wednesday signed a FICCI-TAITRA Carnet Protocol similar to the ATA Carnet backed by an agreement between India-Taipei Association (ITA), Taipei and Taipei Economic and Cultural Centre (TECC), India.

The FICCI-TAITRA Carnet Protocol was signed on behalf of FICCI by Mr Sidharth Birla, Senior Vice President, FICCI, and on behalf of TAITRA by Mr Chao, Yuen-Chuan, President & CEO, TAITRA.

In terms of the FICCI-TAITRA Carnet Protocol, FICCI in India and TAITRA in Taiwan will facilitate the grant of ATA Carnet like document to Indian and Taiwanese businessmen for temporary movement of goods/exhibits for exhibitions/fairs in India and Taiwan.

ATA Carnet is an international uniform Customs document issued in 72 countries including India, which are parties to the Customs Convention on ATA Carnet. The ATA Carnet permits duty free temporary admission of goods into a member country without the need to raise customs bond, payment of duty and fulfillment of other customs formalities in one or a number of foreign countries. The ATA Carnet System is administered by ICC-WCF World ATA Carnet Council (WATAC), Paris in cooperation with the World Customs Organization (WCO). FICCI has been appointed as the National Issuing and Guaranteeing Association for the operation of ATA Carnet System in India.
